Terms of service

Welcome to CryoGear. These Terms of Service (“Terms”) govern your access to and use of cryogear.com (the “Site”) and any purchase you make from CryoGear LLC (“CryoGear,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to purchase from CryoGear. By placing an order, you represent that you are 18 or older and that the information you provide is accurate.

2. Our products

CryoGear sells fragrance decants — fragrance hand-decanted from authentic, legally sourced full bottles into CryoGear’s own clean atomizers and packaging — as well as factory-sealed full bottles (“Cold Storage”) and manufacturer samples (“Genuine Samples”). Except where an item is explicitly described as factory-sealed, products are repackaged by CryoGear and are not sold in original manufacturer packaging.

3. Trademarks and no affiliation

All brand names, trademarks, logos, and product names referenced on the Site are the property of their respective owners. CryoGear is an independent reseller and is not affiliated with, authorized by, sponsored by, or endorsed by any fragrance house, brand, or manufacturer. Brand and product names are used solely to identify and describe the fragrance contained in a given decant or bottle.

4. Product descriptions and accuracy

We work to describe fragrances accurately, including notes and performance impressions. Such descriptions are informational; scent perception, longevity, and projection vary with individual skin chemistry and conditions. We do not warrant that descriptions or other Site content are error-free, complete, or current.

5. Pricing, availability, and orders

Prices and availability are subject to change without notice. We reserve the right to limit quantities, refuse, or cancel any order, and to correct errors in pricing or product information even after an order is submitted. If we cancel an order you have paid for, we will refund the amount charged.

6. Payment

Payments are processed by our payment providers. You represent that you are authorized to use the payment method you provide.

7. Allergens and responsible use

Fragrances contain alcohol and aromatic ingredients that may cause irritation or allergic reaction in some people. We recommend patch-testing before full use. Keep away from eyes, flame, and children. Discontinue use if irritation occurs. You use our products at your own discretion and risk.

8. Intellectual property

The Site and its content — text, images, scent cards, graphics, and branding created by CryoGear — are owned by CryoGear and may not be copied or used without permission.

9. Disclaimer of warranties

Except as required by law, the Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, CryoGear will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless CryoGear from claims arising out of your misuse of the Site or products or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Stearns County, Minnesota.
